Property Assessed Clean Energy (PACE) Loss Reserve Program

History of Regulatory Actions

The California Alternative Energy and Advanced Transportation Financing Authority’s (CAEATFA) proposed emergency regulations establishing the PACE Loss Reserve Program were originally approved by the Office of Administrative Law (OAL) and became effective on March 10, 2014. The emergency regulations were readopted on September 8, 2014, and were readopted for a second time on December 5, 2014.

On January 12, 2015, CAEATFA issued a Notice of Emergency Regulations proposing to suspend the Program’s administrative fee requirement. The proposed emergency regulations were approved by OAL and became effective upon filing with the Secretary of State on January 30, 2015.

The Certificate of Compliance for both emergency rulemaking packages was approved on April 6, 2015.
